Father Sues Funeral Home For Dropping Son's Body
Phillip Maldonado also claims in a lawsuit filed Friday in Boulder District Court that the dropping prior to the wake and open casket viewing caused fluids to leak out of Alex Maldonado’s body, staining the casket lid and shirt of the deceased.
The incident happened in front of Crist Mortuary, 3395 Penrose Place on July 7, just a few days after Alex Maldonado was killed in a traffic crash, according to the lawsuit.
Phillip Maldonado’s lawsuit calls the handling of his son’s body “egregious and outrageous.”
“With Mr. Maldonado watching, one or more of the handlers let go of the casket and dropped it,” the lawsuit states. “The casket went crashing to the cement ground, its lid opened suddenly, and Alex’s body tumbled out and fell directly onto its face directly in front of Mr. Maldonado.”
As a result of the incident, Phillip Maldonado has substantial problems sleeping and has had visions and nightmares, the suit states.
A trial date has not yet been set.
